1. Introduction and effectiveness of the General Conditions

The present general conditions of sale (hereinafter,"General Conditions") have as their object the regulation of the purchase of products and services, carried out remotely and made available, via internet, from the site Molise.Store (hereinafter, the "Site") in accordance with Italian law as per Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, "Consumer Code").

The consumer who accesses the Site to make purchases (hereinafter referred to as "Customer") is required, before sending the order, to carefully read these General Conditions that have been made available to him on the Site.

In the event that the person making purchases on the Site requires the issuance of an invoice and / or is not a "consumer or user" as defined in art. 3, paragraph 1, letter. a) of the Consumer Code, will not apply the rules of withdrawal under Article. 7 and 8 of these Terms and Conditions or, more generally, the provisions of the same Code of Consumer Affairs apply only to "consumers".

Contracts concluded with Molise.Store through the Site are regulated by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian and English.

2. Choosing and ordering Products

The characteristics and price of the various products for sale on the Site (hereinafter "Product" or "Products") are reported on the page for each Product.

In order to purchase the Products, the Client must fill in and send the order form in electronic format, following the instructions contained in the Website.

Orders received from Monday to Friday, excluding holidays, are usually processed within 1 - 3 days.

The order is usually processed in 1 - 3 days after purchase if you choose "Credit Card, Bank Transfer or Paypal" as payment method, within 1 - 3 days after the payment is credited if you choose "Bank Transfer".

We ship in the United States with DHL Express courier: the time to receive the goods from the order processing is 48 - 72 hours.

Orders received from Monday to Friday, excluding holidays, are usually processed within 1 - 3 days.

The order is usually processed in 1 - 3 days after the purchase if you choose as a method of payment "Credit Card, Bank Transfer or Paypal", within 1 - 3 days after the crediting of the payment if you choose "Bank Transfer".

If you wish to receive your order in a country where we do not ship, please contact us.

We will look for a method of shipping together.

In this case the shipment is always and completely at the expense of the recipient.

5. Methods of payment and billing

5.1 Payment methods

On Molise.Store you can pay the price of products and related shipping costs with Credit Card, PayPal, Bank Transfer, Prepaid Cards.

Credit Card

The circuits on which you can buy on the site are:

  • Visa / Visa Electron
  • Mastercard / Maestro
  • American Express

The Site does not store your credit card number, with the payment by credit card you will not be charged any kind of surcharge.

PayPal

Once you have confirmed your order, you will be redirected to the PayPal website where you can pay with your account or using a card, even a prepaid card, or in any case according to the methods accepted by PayPal and in compliance with its conditions.

Bank transfer

The transfer must be made within 3 days from the date of the order. If this does not occur the order will be canceled. If you have not made the transfer you will be contacted by Customer Service in order to clarify whether the cause of non-credit is due to the desire not to confirm the purchase or other causes.

The reason for the transfer must indicate the date, the order number, which can be found in the confirmation email, and the name and surname of the payer (e.g. "Order 15/05/15 n. 100010001, Mario Rossi").

The transfer is credited to the account of the beneficiary (?) not earlier than 2/3 working days after its execution.

5.2 Invoicing of orders

If the purchase is made by a professional or a company, it will be possible to request the issuance of an invoice by contacting customer service after the order process and entering the billing information including tax code and / or VAT number. In this case the invoice will be sent by email to the address indicated. The professional is responsible for the correct insertion of the invoicing data and is expressly informed that, in case the invoice is not requested during the order process, it will not be possible to request it later.

6. Transport and Delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase process in the appropriate field.

All purchases will be delivered by express courier (hereinafter,"Courier") from Monday to Friday, excluding holidays and national holidays. Molise.Store is not responsible for delays not foreseeable or not attributable to it.

Once the Products have been shipped, the Customer will receive a confirmation email which will include a link to refer to for tracking the shipment.

In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered within a period of 7 (seven) working days from the day after the day on which Molise.Store has confirmed the order to the Customer through a specific order confirmation email. The aforementioned period of 7 working days applies to shipments in Italy.

We will not accept requests for reimbursement caused by delays in delivery by the courier as these events are part of force majeure and therefore not our responsibility.

7. Errors and limitations of liability

The information relating to the Products provided through the Site is constantly updated. It is not possible, however, to guarantee the complete absence of errors of which, therefore, Molise.Store can not be held responsible.

Molise.Store reserves the right to correct errors, inaccuracies or omissions even after an order has been placed, or to change or update information at any time without prior notice, without prejudice to the rights of the Customer under these Terms.

RETURN OF A NON-COMPLIANT AND/OR DAMAGED PRODUCT

If you have received a product that is obviously damaged, non-compliant, defective or incorrect, you can request a refund for the item by notifying Customer Service via the Support Ticket, Contact Us page or by calling one of the telephone numbers on the Contact Us page.

Upon receipt of your order, you will still have to wait for the delivery update in your personal account. Once the update has taken place, it will be possible to proceed with the return request.

With the same procedure, if there are the conditions, you can withdraw from the purchase, communicating it within a maximum of 3 days from receipt of goods.

RETURN REQUEST MODALITIES

For some of our food products the right of withdrawal does not apply.

LEGAL GUARANTEE OF CONFORMITY

In case of defects and / or non-conformity, exclusively with reference to non-food products, you will be entitled to restore the conformity of the product, by repair or replacement, or alternative remedies in the cases expressly provided for by art. 130 of Legislative Decree no. 206/2005.
In such cases you may request the repair or replacement or reimbursement of the item within and no later than 2 (two) months from discovery. Pursuant to and for the purposes of European Directive 44/99/EC and articles 128 et seq. of Italian Legislative Decree no. 206/2005 (Consumer Code), the products you have purchased are covered by the legal guarantee of conformity, which covers conformity defects of products for a maximum period of 24 (twenty-four) months from their delivery.

Once the procedure has been completed, you will receive a confirmation e-mail containing the return form and all the instructions for proceeding with the shipment.
The authorisation to return the product will not constitute in any way an acknowledgement of non-conformity, the existence of which must be ascertained by us after the return.

We reserve the right to proceed with the refund of the defective item only after having carried out the appropriate checks to verify the actual non-conformity of the returned product.

If the product's non-conformity is ascertained, we will make the refund using the same method of payment used for the purchase (credit card, prepaid card, PayPal, etc.) or by bank transfer.
